Legalities

Identification

You are required to provide two forms of identification, these can include: 

  • Original Birth Certificates
  • Australian or foreign passport
  • Current drivers licence
  • Current proof of age card


If you were born outside of Australia and do not have a birth certificate;

  • You will need to provide an original passport which shows your date and place of birth
  • In addition to the above, you will need to provide a second identification as per the above.

Previously Married, Divorced or widowed

If either one or both of the parties to be married have previously been married you are required to provide proof that a previous marriage has ended (whichever is applicable): 

  • Divorce Decree Absolute
  • Death Certificate 

Name Change

Deed Poll of change of name is applicable.

Notice of Intended Marriage (NOIM)

  • The NOIM must be lodged at least one month before the wedding date ( If there is less than 1 month until your wedding, talk to your authorised marriage celebrant). 
  • The NOIM is valid for 18 months.
  • The official notice period begins on the day you lodge the completed NOIM with your authorised marriage celebrant.
  • The form needs to be witnessed by an Authorised Person before it can be lodged.  

Witnesses and Translation/Interpreter

  • Two witnesses over the age of 18 must be in attendance at your wedding ceremony and for the signing of the marriage certificate.
  • All your documents must be in English.  If your documents are not in English, you are required to  supply an accredited translation if they are in another language. 
  • If either one or both of the parties to be married can't speak or understand English, then an interpreter must be at your wedding ceremony.

Happily Ever... Before and After

Although it's not mandatory to attend pre-marriage courses for a civil ceremony, it's worth noting that civil celebrants are required to provide couples they marry with a government information pamphlet called "Happily Ever...  Before and After" and the details of pre-marriage education courses that are available, as well as urging you to consider enrolling in one. So, while you don't have to take a course, it's something to keep in mind if you're planning to tie the knot.
